Terms of Service

1. Introduction and Acceptance

These Terms of Service (“Terms”) are a binding agreement between you and Horsegirl (“Horsegirl,” “we,” “us,” or “our”), operated by Piotr Morawski. They govern your access to and use of the Horsegirl mobile application (the “App”), this website, and any related services (together, the “Service”).

By creating an account, downloading the App, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which describes how we collect, use, and protect your information and is incorporated into these Terms by reference. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old (or at least 13 years old if you are located in the United States) to use the Service, and you must be able to form a legally binding contract in your jurisdiction. By using the Service, you represent that you meet these requirements. If you are using the Service on behalf of a stable, business, or other organization, you represent that you have the authority to bind that organization to these Terms.

3. Accounts and Workspaces

We use Clerk, a third-party identity provider, to manage account registration and sign-in, including email and password, Google, and Apple sign-in. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate registration information and to keep it up to date, and each account is for use by a single individual.

Horses, stables, rides, and tasks may belong to a shared “workspace” that is visible to other members you invite or who share that workspace with you — for example, co-owners of a horse or other riders at your stable. If you add another member to a workspace, that member will be able to view and, depending on their role, edit the records in that workspace. You are responsible for choosing who you share a workspace with and for what you enter into a shared workspace.

4. Subscriptions, Trials, and Payment

Certain features of the Service may require a paid subscription. Subscriptions are sold and processed through the Apple App Store or Google Play and managed using RevenueCat; Horsegirl never receives or stores your payment card details.

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You can manage or cancel your subscription at any time through your Apple ID account settings or Google Play account settings — cancelling in the App Store or Google Play, not within the App itself, is what stops future billing. Refunds, proration, and billing disputes are handled by Apple or Google under their own policies; Horsegirl does not process refunds directly and cannot guarantee a refund will be granted. We may change subscription pricing from time to time; where required, we or the applicable platform will give you advance notice before a price change takes effect on your next renewal.

5. Your Content and Data You Provide

You retain ownership of the content and information you submit to the Service, including horse records, photos, documents, and notes (“Your Content”). By submitting Your Content, you grant Horsegirl a limited, worldwide, non-exclusive license to host, store, reproduce, sync, and display it solely as necessary to provide and operate the Service for you and the members of your workspace.

Some of Your Content may include personal information about people who are not Horsegirl users — for example, a horse's owner, a veterinarian, farrier, or other care provider, or an emergency contact. By submitting this information, you represent that you have the appropriate right or basis to share it with us and that your doing so complies with applicable law. You are solely responsible for the accuracy of Your Content and for having any necessary rights or consents to submit it.

6. Health, Safety, and AI Features

Not veterinary or medical advice

Horse health records, weight and health insights, and AI-generated suggestions (for example, equipment recognition or care recommendations powered by OpenAI) are provided for informational purposes only. They are not veterinary or medical advice and are not a substitute for consultation with a licensed veterinarian or other qualified professional. Always seek the advice of a veterinarian with any questions about your horse's health.

The SOS feature is not an emergency service

The Service includes an optional stand-still and fall-detection safety feature. This feature works entirely on your device: when triggered, it displays an on-screen countdown and alert that you or someone near you must notice and act on. It does not automatically call, text, or otherwise notify your emergency contact, emergency services, or Horsegirl, and it does not guarantee that a fall, impact, or emergency will be detected. This feature is not a monitored emergency response or medical alert service, and it must never be relied upon as a substitute for calling local emergency services yourself. You use this feature entirely at your own risk.

Heart-rate and fitness data

Heart-rate data sourced from Apple Health, Google Health Connect, or a paired Bluetooth heart-rate monitor is provided for informational and fitness purposes only. It is not generated by a medical-grade device and should not be used to diagnose, treat, or make medical decisions for you or your horse.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • Reverse-engineer, decompile, scrape, or attempt to circumvent any security or access control of the Service;
  • Upload content that is unlawful, infringing, defamatory, or that violates the rights of any third party;
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity;
  • Interfere with or disrupt the operation of the Service or the experience of other users or workspaces;
  • Provide false or misleading emergency-contact, care-provider, or ownership information, or enter such information about a real person without an appropriate basis to do so; or
  • Use the Service to build a competing product or service.

8. Third-Party Services

The Service relies on third-party providers to operate, including Clerk (authentication), OneSignal (push notifications), PostHog (product analytics), RevenueCat together with the Apple App Store and Google Play (subscriptions and purchases), Amazon Web Services (file and photo storage), OpenAI (AI-assisted suggestions), Mapbox (address search and maps), and Open-Meteo (weather). These providers operate under their own terms and privacy policies, and Horsegirl is not responsible for their independent acts, omissions, or availability.

9. Intellectual Property

The Service, including its software, design, text, graphics, and the Horsegirl name and logo, is owned by Horsegirl or its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of the Service, nor use our trademarks or branding, without our prior written permission.

10. Feedback

If you send us feedback, suggestions, or ideas about the Service, you agree that we may use them for any purpose without any obligation or compensation to you.

11. Apple and Google Platform Terms

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Horsegirl only, not Apple, and Apple has no obligation to furnish any maintenance or support for the App. Your license to use the App is limited to a non-transferable license to use it on an Apple-branded device that you own or control, as permitted by the App Store's usage rules. Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection law. Apple is a third-party beneficiary of these Terms and may enforce them against you.

If you downloaded the App from Google Play, your use of the App is also subject to Google Play's applicable terms of service.

12. Termination

You may stop using the Service and delete your account at any time from within the App. Deleting your account permanently deletes your rider profile, SOS settings, and notifications, and deletes your workspace data (tasks, horses, rides, health and training records, and related files) once no other member remains on that workspace, consistent with our Privacy Policy.

We may suspend or terminate your access to the Service if you breach these Terms, if required to comply with the law, or to protect the safety or rights of Horsegirl, other users, or third parties. Upon termination, your right to use the Service ends immediately; provisions of these Terms that by their nature should survive termination (including Sections 6, 9, 13, 14, 15, and 16) will continue to apply.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that GPS location or ride telemetry will always be accurate, or that AI-generated suggestions or notifications will always be timely, accurate, or delivered. This disclaimer applies to the fullest extent permitted by applicable law and does not affect any statutory rights you may have as a consumer that cannot be excluded under applicable law.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Horsegirl will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or related to your use of the Service — including any harm arising from reliance on the SOS safety feature, AI-generated suggestions, or health or fitness data. To the fullest extent permitted by applicable law, Horsegirl's total liability for any claim arising out of or related to the Service will not exceed the amount you paid us in the twelve months before the claim arose, or 50 euros if you have not made any payment to us.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, death or personal injury caused by our negligence, or statutory consumer-protection rights that cannot be waived under the law of your country of residence.

15. Indemnification

You agree to indemnify and hold Horsegirl harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or Your Content, including any third-party personal data you submit without an appropriate right or basis to do so.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of Germany, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Germany, except that if you are a consumer habitually resident in the European Economic Area, the United Kingdom, or another jurisdiction whose law does not permit this choice to deprive you of the protection of your local mandatory consumer-protection law, you retain the right to bring proceedings before the courts of your own country of residence, and that law's mandatory protections continue to apply to you regardless of this Section.

17. Changes to These Terms

We may update these Terms from time to time. We will update the “Last updated” date above, and if a change is material, we will provide additional notice through the App or by email. Your continued use of the Service after a change takes effect constitutes your acceptance of the revised Terms.

18. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Horsegirl regarding the Service. Our failure to enforce any right or provision will not be considered a waiver of that right or provision. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign these Terms without our prior written consent. We are not liable for any failure to perform caused by circumstances beyond our reasonable control.
